Picky — Terms and Conditions

1. Who we are

Picky is operated by Nikita Kyrushko, an individual based in the United Kingdom trading as "Picky" ("Picky", "we", "us"). Picky is run by an individual, not a registered company. You can contact us at hello.picky.ai@gmail.com.

These terms govern your use of the Picky mobile application, the get-picky.com website, and the services available through them (together, the "Service"). By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.

Our Privacy Policy (available at get-picky.com/privacy) explains how we handle your personal data and forms part of your agreement with us.

2. What Picky is — and what it is not

Picky scans restaurant menus and uses artificial intelligence to flag dishes as SAFE, CHECK or AVOID against the food restrictions you tell us about.

Referral links grant bonus scans (currently +5 each) to both the referrer and the new user when a referral is validly applied at signup. Referral rewards have no cash value, may be adjusted or withdrawn prospectively at any time, and may be revoked where we reasonably believe codes are being farmed, shared publicly at scale, or otherwise abused.

7. Your content and our licence

You keep ownership of the content you upload (menu photos, meal ratings, notes). You grant us a non-exclusive, worldwide, royalty-free licence to host, process and display that content solely to operate and improve the Service — including sending menu images to our AI provider to generate verdicts and producing aggregated, non-identifying community statistics as described in the Privacy Policy. This licence ends when you delete the content or your account, except for aggregated data that no longer identifies you and copies held in routine backups for a limited period.

8. Our intellectual property

The Service — including the Picky name, logo, app, website, design and generated verdict presentation — is owned by us or our licensors. We grant you a personal, non-transferable, revocable licence to use the app and website for their intended purpose. No other rights are granted.

9. Availability and changes

The Service is provided on an "as available" basis. We may modify features, run maintenance, or withdraw the Service. If we permanently withdraw a paid feature you have prepaid for, we will refund the unused portion. We are not liable for outages caused by third-party providers (hosting, AI, payments) or events outside our reasonable control.

10. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under the law of England and Wales.

11. Termination

You can stop using Picky and delete your account at any time (Settings, or by contacting us — deletion is described in the Privacy Policy). We may suspend or terminate your account for material breach of these terms; where the breach is remediable we will normally give you notice and a chance to fix it first. On termination your licence to use the Service ends; sections which by their nature should survive (2, 7, 8, 10, 13) survive.

12. Changes to these terms

We may update these terms from time to time. For material changes we will give at least 30 days' notice in the app or by email. Continued use after the effective date constitutes acceptance; if you do not agree, stop using the Service and, if you have a subscription, cancel it before renewal.
